Frequently Asked Questions
Estate planning involves creating a comprehensive strategy to manage and distribute your assets in the event of incapacity or death. It ensures that your wishes are honored, protects your loved ones, and minimizes potential legal disputes. Proper estate planning can also help reduce tax liabilities and simplify the estate administration process.
A trust is a legal entity that holds assets on behalf of beneficiaries. It allows for greater control over how assets are managed and distributed, even after your passing. Trusts can be useful for minimizing estate taxes, avoiding probate, and providing for beneficiaries with specific needs or circumstances.
An executor, also known as a personal representative, is a person appointed in a will to carry out the instructions of the deceased during the estate administration process. Their responsibilities include managing assets, paying debts and taxes, distributing property to beneficiaries, and handling any legal matters related to the estate.
Yes, you can contest a will if you have valid legal grounds to do so. Common reasons for contesting a will include lack of testamentary capacity, undue influence, fraud, or a mistake in the will’s execution. Contesting a will can be complex, so it’s essential to seek legal advice from an experienced trusts and estates attorney.
It’s advisable to review your estate plan periodically or whenever significant life events occur, such as marriage, divorce, the birth of a child, or a substantial change in financial circumstances. Regular reviews ensure that your estate plan remains up-to-date and reflects your current wishes and goals.

About Myself
Prior to starting her own private practice, Marianna Schwartsman practiced law at the New York City law firm of Katten Muchin Rosenman LLP for nine years where she obtained comprehensive knowledge of trusts and estate laws. She later practiced at the Long Island law firm of Meltzer Lippe Goldstein and Breitstone LLP, where she focused her practice in the trusts and estates area of law and expanded her knowledge into areas of income tax and basis planning methods.
Marianna is a 2007 graduate of Fordham University School of Law, Summa Cum Laude, and is admitted to practice in New York. At Katten, Marianna focused on estates and trusts administration, and domestic and international estate planning. After many years of learning and perfecting her knowledge of trusts and estate tax and State laws, Marianna moved on to Meltzer Lipper Goldstein and Breitstone LLP to continue learning and practicing in the area of personal planning. After three years with Meltzer Lippe Goldstein and Breitstone LLP, Marianna felt that it was time to start her own practice and started Schwartsman Law Group PLLC.
